Service Agreement

This is the standard EMCO Booth Service Agreement every client signs at checkout. Your signed copy, with your booking details, is in your client portal.
Booking deposit
A non-refundable deposit of 35% of the booking total (before tax) is required to secure your date. No event is officially booked until the deposit is received.
Card payments include a 5% processing fee. Processing fees are non-refundable. Zelle payments have no processing fee.
Final payment and taxes
The remaining balance, plus all sales tax for the event location, is due:
- Delivery bookings: 7 days before the event.
- Pick up bookings: at pick up, before any equipment is released.
If the balance is not paid when due, EMCO Booth may cancel the booking and keep the deposit. Equipment will not be delivered or released until the booking is paid in full.
Sales tax is based on the event location. If the event location changes, the tax is updated to match.
Cancellations and date changes
All cancellations must be sent to EMCO Booth in writing, through your client portal or by email. No refunds will be issued under any circumstance. Store credit may be granted based on timing:
- 30+ days before the event: full store credit, minus processing fees.
- 14 to 30 days before the event: store credit, minus the deposit and processing fees.
- Less than 14 days before the event: 50% store credit, minus processing fees.
Store credit is valid for 2 years from the original event date.
Date changes are subject to availability and must be requested at least 14 days before the original event date. Amounts paid carry over to the new date.
If EMCO Booth cancels (excluding force majeure), you receive a full refund of the amounts paid, sent within 7 to 14 business days.
Refunds, chargebacks and disputes
All sales are final. Once equipment is picked up, delivered or set up, no refunds will be issued for any reason. This includes last-minute cancellations, delays, guest no-shows, dissatisfaction or partial use of the service. At that point the booking is considered active and only store credit may be offered, at EMCO Booth's discretion.
Digital photos and media are delivered within 14 business days after the event. Not receiving digital content sooner is not grounds for a refund or chargeback.
The Client agrees not to start a chargeback or payment dispute after equipment has been released or services have been delivered. If a payment is reversed or disputed after that point, EMCO Booth may:
- Pursue legal or collections action for the full amount owed, plus fees and costs.
- Cancel any store credit and refuse future bookings.
- Submit this signed agreement and its signing record to the card issuer as evidence.
False or malicious disputes will be treated as fraud.
Pick up and return (pick up bookings)
The Client, or an adult (18+) named by the Client, must pick up the equipment at the agreed time and location and show a photo ID that matches the booking.
The Client checks the equipment at pick up. By taking the equipment, the Client confirms it is complete and working, unless a problem is reported to EMCO Booth before leaving.
From pick up until return, the equipment is in the Client's care. The Client must:
- Transport it in a closed vehicle and keep it protected from rain, heat, cold and theft.
- Never leave it unattended outdoors or in an unlocked vehicle.
- Use it only at the booked event, and never lend, rent or sublet it.
- Follow the setup instructions provided by EMCO Booth.
The equipment must be returned clean, complete and in its cases by the agreed return time. A late return fee of $100 per day applies until it is returned. Missing parts, cases, props or accessories are charged at full replacement cost.
Setup problems caused by not following instructions are not grounds for a refund. EMCO Booth will give phone or text support where possible.
Delivery, setup and rental time (delivery bookings)
Our attendant arrives about 30 minutes before the start time to set up. Early setup outside this window may incur idle time charges of $100 per hour.
Rental time begins and ends at the contracted time, even if the event starts late. Extra time must be requested and paid for in advance.
Access, parking and venue
The Client must provide accurate venue details (address, contact name and phone) and guaranteed legal parking and loading access for one vehicle. If parking or access is not available, EMCO Booth may cancel the service on site with no refund.
Space and power requirements:
- Standard booths: minimum 5x5 ft.
- 360 booths and inflatables: minimum 10x10 ft.
- A working power outlet within 6 ft of the setup area.
Stairs, elevators or long walking distances must be disclosed in advance. Delays caused by these conditions, or by restricted access or unstable power, may shorten your booth time, and the full amount remains due.
Equipment damage, loss and theft
The Client is financially responsible for any damage, loss or theft of equipment caused by the Client, guests or third parties, from pick up or delivery until the equipment is returned or packed up by EMCO Booth. This includes full repair or replacement cost and lost income from future bookings that cannot be fulfilled.
Damage, loss and late fees are due within 7 days of the invoice. Unpaid amounts may be sent to collections, and the Client agrees to pay reasonable collection costs and attorney fees.
Force majeure
EMCO Booth is not responsible for missed or interrupted service due to events beyond our control, including severe weather, illness, equipment failure, traffic or accidents, and venue access restrictions. In such cases, a full store credit is issued, valid for 2 years.
Conduct and early termination
EMCO Booth may end services on site, without refund, if staff are subjected to verbal abuse, threats or aggressive behavior, if equipment is at risk of being damaged, or if venue conditions are unsafe or unusable.
Children under 12 must be supervised at all times. Guests causing disruptions may be denied booth access.
Liability
EMCO Booth is not liable for lost, stolen or damaged personal property of guests, or for injuries not caused by the direct negligence of our staff. Props are sanitized to the best of our ability; EMCO Booth is not responsible for allergic reactions, clothing damage or illness from prop use.
EMCO Booth's total liability for any claim is limited to the amount paid for the booking. EMCO Booth is not liable for indirect, incidental or consequential losses.
The Client agrees to indemnify and hold EMCO Booth harmless from any claims related to the use of the equipment or services, including claims by guests or the venue.
Ownership of content and usage rights
All content (photos, videos, digital overlays and graphics) created with EMCO Booth equipment is the property of EMCO Booth. Personal and non-profit sharing is permitted. Content may not be sold, licensed or used for advertising without purchasing usage rights in advance.
Guests using the booth consent to EMCO Booth using photos and videos for marketing, including our website and social media. Guests who object must tell the attendant at the event, or the Client must opt out in writing before the event.
Equipment substitution and technical issues
EMCO Booth may substitute equipment or booth type in case of malfunction, unavailability or last-minute logistics, with a comparable or upgraded booth of equal value.
If a technical issue happens (printer jam, camera reboot, software freeze, power reset), EMCO Booth will work to restore service as quickly as possible. These delays are not grounds for a refund, partial refund or chargeback. Use of any part of the service means the booking is fulfilled. Extra time or store credit may be offered as a courtesy, not an obligation.
Electronic signature and records
The Client agrees that their drawn signature and typed name on this agreement are a legally binding electronic signature under the U.S. ESIGN Act and the Uniform Electronic Transactions Act (UETA).
To verify the signature, EMCO Booth records the signer's IP address, device and browser details, the date and time, and the device location if the signer allows it. This record, together with a secure fingerprint of the signed agreement, may be used as evidence in any dispute or chargeback.
Governing law and general terms
This Agreement is governed by the laws of the state in which EMCO Booth is registered. Disputes will be resolved in the courts of that state. If EMCO Booth must take action to collect money owed under this Agreement, the Client agrees to pay reasonable attorney fees and costs.
If any part of this Agreement is found unenforceable, the rest remains in effect. This Agreement, together with your booking details, is the entire agreement between the parties. Changes must be made in writing.
Client acknowledgement
By signing this Agreement, you confirm that you understand and agree to the following:
- The deposit and card processing fees are non-refundable.
- The balance plus tax is due 7 days before the event (delivery) or at pick up.
- No refunds once equipment is picked up, delivered or set up.
- You are responsible for the equipment while it is in your care.
- Chargebacks and payment disputes are prohibited once services are delivered.
- Digital content may take up to 14 business days to arrive.
- EMCO Booth owns all content unless a license is purchased.
